Welcome to Tatvartha WealthNest AI Private Limited! 
These Terms and Conditions (“Terms”) govern your use of the WealthNest.AI® mobile application (“App”), provided by Tatvartha WealthNest AI Private Limited (“Company,” “we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy 

  1. User Consent

By registering, accessing, or using the WealthNest.AI App, you explicitly consent to: 

  1. Data Processing: the collection, storage, and use of your personal and financial data in accordance with our Privacy Policy. This includes information you voluntarily provide (e.g., profile data, financial inputs) and data obtained through authorized third-party integrations. 
  1. Purpose Limitation: We process only such data as is reasonably necessary to deliver and improve our services, perform onboarding and KYC verification, enable analytics, and comply with applicable laws. 
  1. Device Permissions: Access to your device’s camera, microphone, or location may be requested once or as required for identity verification, document upload, or feature enablement. Permission requests will always be preceded by a clear prompt. 
  1. Withdrawal of Consent: You may withdraw your consent at any time by deleting your account or contacting our Data Protection Officer, subject to retention obligations under law (e.g., taxation, AML/KYC requirements). 
  1. Cross-Border Transfers (if applicable): Your data may be processed on servers located in or outside India, with equivalent protection safeguards in place. 

Use of the App after any policy update will constitute renewed consent to the revised terms. 

  1. User Responsibilities
  1. Account Security: 
    You are responsible for maintaining the confidentiality of your login credentials and any device used to access the App. You agree to promptly notify WealthNest.AI of any unauthorized access, breach, or suspected compromise of your account. 
  1. Accuracy of Information: 
    You agree to provide true, current, and complete information during registration and onboarding. Where applicable, you shall complete Know Your Customer (KYC) verification and other identity checks as required under RBI, SEBI, or other regulatory guidelines. 
  1. Lawful Use: 
    You agree to use the App and related services only for lawful purposes and in accordance with all applicable Indian laws, including but not limited to data-protection, anti-money-laundering (AML), and cybersecurity regulations. 
  1. Prohibited Conduct: 
    You shall not: 
  1. misuse, hack, interfere with, reverse-engineer, copy, or exploit the App or its features; 
  1. attempt to bypass security or access controls; 
  1. use automated bots, scripts, or scraping tools without authorization; 
  1. upload or transmit harmful code, malware, or deceptive content; or 
  1. engage in activities that could harm, disable, or overload the platform. 
  1. Financial Responsibility: 
    You remain solely responsible for any decisions, financial actions, or transactions made using insights or data from the App. WealthNest.AI does not provide investment advice and recommendation and is not responsible for user-initiated actions. 
  1. Reporting Obligations: 
    You must immediately report any suspicious activity, unauthorized access, or potential security breach related to your account or WealthNest.AI systems. 
  1. Compliance Cooperation: 
    You agree to cooperate with any compliance or investigative requests by authorized authorities or WealthNest.AI in connection with lawful data or transaction verification. 
  1. Service Scope

WealthNest.AI is a technology-driven financial platform that provides AI-based analytics, insights, and digital tools to help users understand, track, and manage their financial portfolios. Our platform enables access to various financial products and services, including but not limited to: 

  • Life and General Insurance (underwritten and issued by licensed insurance partners registered with the Insurance Regulatory and Development Authority of India – IRDAI); 
  • Mutual Fund Distribution (facilitated through registered AMFI or SEBI-authorized distributors); and 
  • Portfolio Management and Investment Advisory Services (delivered by duly licensed SEBI-registered Portfolio Managers or Advisors). 

 

WealthNest.AI itself does not hold any license to sell, underwrite, or advise on financial products. The platform serves as a digital facilitator, connecting users with authorized and regulated partners. All transactions, risk assessments, or investment activities are governed by the respective partner’s terms, disclosures, and regulatory frameworks. 

All insights, analytics, or AI-generated suggestions provided by WealthNest.AI are for informational and educational purposes only and do not constitute personalized financial, investment, tax, or legal advice. Users are encouraged to seek independent professional advice before acting on any information provided through the platform. 

WealthNest.AI makes no warranties regarding specific returns, portfolio performance, or product suitability. The platform’s analytics are based on available data, partner APIs, and evolving algorithms, which may change without prior notice. 

  1. Data Security & DPDP Compliance

WealthNest.AI is committed to protecting your personal and financial information in accordance with the Digital Personal Data Protection Act, 2023 (“DPDP Act”), and all applicable RBI and SEBI data-governance guidelines. 

  1. Lawful and Purpose-Driven Processing: 
    All data collected from users is processed lawfully, fairly, and only for explicit, legitimate, and stated purposes, such as delivering platform functionality, completing KYC, enabling partner integrations, and improving user experience. 
  1. Data Minimization and Retention: 
    We collect and retain only the minimum personal and financial data necessary to provide our services. Data is retained only for as long as required by law or for legitimate operational purposes and securely deleted thereafter. 
  1. Security Measures: 
    We employ industry-standard encryption, tokenization, firewalls, and secure server infrastructure to protect your data from unauthorized access, alteration, disclosure, or destruction. Access to user data is strictly controlled and monitored. 
  1. Third-Party Integrations: 
    Where required, we may securely connect with third-party APIs, licensed Account Aggregators, or regulated financial institutions authorized by the RBI or SEBI. Any data sharing occurs only with your explicit and revocable consent. 
  1. Banking Credentials: 
    We do not store or retain your net banking, card, or login credentials. Authentication and financial data retrieval, where applicable, occur through secure, RBI-compliant mechanisms. 
  1. Cross-Border and Cloud Storage: 
    Your data may be processed or stored on cloud infrastructure located in or outside India, subject to equivalent or higher security and privacy standards. 
  1. Data Breach and Grievance Redressal: 
    In the unlikely event of a personal data breach, you will be notified promptly in accordance with the DPDP Act. A designated Data Protection Officer (DPO) shall handle grievances or data-related requests via the contact details provided in our Privacy Policy. 
  1. AI & Analytics Disclaimer

WealthNest.AI utilizes artificial intelligence, data analytics, and predictive models to generate financial insights, risk assessments, and portfolio projections. While every effort is made to ensure data accuracy and model integrity, all AI-generated outputs are algorithmic estimations based on available data and may not reflect real-time market movements, macroeconomic changes, or unforeseen events. 

  1. Informational Nature: 
    All insights, recommendations, or forecasts generated by the platform are for informational and educational purposes only. They do not constitute financial, investment, tax, or legal advice, nor should they be construed as solicitation or endorsement of any security, instrument, or product. 
  1. Algorithmic Limitations: 
    AI models are subject to limitations such as data latency, incomplete datasets, model drift, or statistical inaccuracies. Results may vary depending on user inputs, external data feeds, or market conditions. 
  1. No Guarantee of Accuracy or Performance: 
    WealthNest.AI makes no warranty regarding the accuracy, reliability, timeliness, or completeness of any AI-driven insight. Past performance, back-tested results, or simulated projections do not guarantee future outcomes. 
  1. User Responsibility: 
    Users are solely responsible for independently evaluating the information and for making any investment, financial, or strategic decisions based on their personal judgment or after consulting qualified professionals. WealthNest.AI shall not be liable for any financial loss, damage, or decision made in reliance on AI-generated output. 
  1. Continuous Improvement: 
    AI models and analytical algorithms are periodically updated, retrained, and improved using anonymized datasets and user feedback. Such updates may change or replace previous outputs without prior notice. 
  1. Intellectual Property

All content, design elements, source code, software architecture, algorithms, data models, user interfaces, graphics, trademarks, logos, and other intellectual property forming part of the WealthNest.AI platform are the exclusive property of Tatvartha WealthNest AI Private Limited, unless otherwise stated. 
All rights are reserved under applicable copyright, trademark, and intellectual property laws of India and international treaties. 

  1. Ownership: 
  1. “WealthNest.AI,” the logo, and associated branding are registered or pending trademarks of Tatvartha WealthNest AI Private Limited. 
  1. All proprietary algorithms, AI models, analytics engines, and platform code constitute confidential and protected intellectual property of the Company. 
  1. User License: 
    Subject to compliance with these Terms, users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App and its services solely for personal and lawful purposes. No ownership or IP rights are transferred to the user. 
  1. Restrictions: 
    You may not copy, modify, reproduce, distribute, reverse-engineer, decompile, disassemble, publicly display, or create derivative works based on any portion of the App or its software without prior written authorization from Tatvartha WealthNest AI Private Limited. 
  1. Third-Party Content: 
    Any trademarks, logos, or content belonging to partner entities, fund houses, or insurers displayed on the App remain their respective intellectual property and are used under license or fair-use principles. 
  1. User Data and Feedback: 
    Any data voluntarily provided by users remains their property. However, by submitting information or feedback, users grant WealthNest.AI a non-exclusive, royalty-free, worldwide license to use anonymized data for service improvement, analytics, and AI model training, in accordance with the Privacy Policy. 
  1. Limitation of Liability

The App and all related services are provided on an “as is” and “as available” basis. While we strive to ensure accuracy and uptime, we make no guarantees regarding data accuracy, uninterrupted access, or suitability for any specific purpose. 

To the fullest extent permitted by law: 

  • WealthNest.AI, its founders, affiliates, employees, or partners shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, profits, revenue, or goodwill. 
  • For paid users, our total aggregate liability for any claim shall not exceed the total amount paid by you in the three (3) months immediately preceding the date of such claim. 
  • For free users, our total liability shall not exceed ₹100 (INR one hundred) or the equivalent amount paid (if any), whichever is lesser. 

You acknowledge that this limitation forms an essential basis of the agreement between you and WealthNest.AI. 

  1. Indemnification

You agree to indemnify, defend, and hold harmless WealthNest.AI, its parent entities, directors, officers, employees, partners, affiliates, and licensors from and against any and all claims, demands, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or related to: 

  • Your use or misuse of the App, website, APIs, or related services; 
  • Your violation of these Terms, any applicable law, or third-party rights; 
  • Your submissions or content, including financial data, inputs, or information you upload, share, or authorize us to process; 
  • Any reliance placed by you or others on AI-generated analyses, insights, or recommendations provided through the platform; and 
  • Unauthorized access to or use of your account or credentials due to your negligence or omission. 

WealthNest.AI reserves the right, at your expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you. You agree to cooperate fully in asserting any available defenses. 

  1. Modification and Termination

WealthNest.AI reserves the right, at its sole discretion, to modify, suspend, or discontinue the App, website, or any related service, feature, or pricing at any time, with or without prior notice. 

We may update or amend these Terms periodically to reflect changes in our business, technology, or applicable laws. Material updates will be notified to you via email, in-app notice, or website posting. Your continued use of the App after such updates constitutes your acceptance of the revised Terms. 

We may terminate or restrict your account or access (temporarily or permanently) without prior notice if: 

  • You violate or breach these Terms, any applicable law, or regulatory requirement; 
  • You misuse or attempt to compromise the security, performance, or integrity of the App; 
  • You engage in fraudulent, abusive, or unlawful activities; or 
  • We are required to do so by law, regulation, or governmental order. 

Upon termination: 

  • Your right to access or use the App shall immediately cease; 
  • Any outstanding obligations or dues shall remain payable; and 
  • We may retain or delete your data in accordance with our Privacy Policy and applicable laws. 

We shall not be liable to you or any third party for any modification, suspension, or termination of services under this clause. 

 

  1. Platform Availability & Maintenance
    WealthNest.AI strives to ensure continuous access to its App and services; however, temporary suspension may occur for scheduled maintenance, system upgrades, or unforeseen technical issues. Such downtime shall notconstitute a breach of these Terms or entitle any refund or compensation. WealthNest.AI will make reasonable efforts to notify users of planned maintenance in advance. 
  2. Website Use & External Links
  1. Website Access and Availability 
    The WealthNest.AI website may be temporarily unavailable due to maintenance, upgrades, or unforeseen issues. While we strive to ensure uninterrupted service, we make no warranty that the website or any content will always be available, error-free, or free from interruptions. 
  1. External Links 
    The website may contain links to third-party sites, resources, or applications (“External Links”). These are provided solely for user convenience. WealthNest.AI does not control, endorse, or assume responsibility for the content, accuracy, or security of any External Links. Accessing any third-party link is at your own risk, and you should review that site’s own terms and privacy policies. 
  1. Linking to Our Website 
    You may link to the WealthNest.AI homepage only in a manner that is fair, legal, and does not damage or take advantage of our reputation. Deep-linking, framing, or implying association, approval, or endorsement without prior written consent is strictly prohibited. We reserve the right to withdraw linking permission at any time without notice. 
  1. Viruses and Malicious Code 
    You are responsible for using appropriate anti-virus protection and security controls when accessing our website. You must not knowingly introduce viruses, trojans, worms, logic bombs, or other harmful material. Any attempt to gain unauthorized access to the site, its servers, or related systems will be treated as a security breach and may be reported to law-enforcement authorities under applicable cyber-laws.

  1. 12. Governing Law & Dispute Resolution

These Terms and any dispute, claim, or controversy arising out of or in connection with your use of the WealthNest.AI platform shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. 

  1. Jurisdiction: 
    All disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India where the registered office of Tatvartha WealthNest AI Private Limited is situated. 
  1. Amicable Resolution: 
    In the event of any dispute, the parties shall first attempt to resolve the matter amicably through mutual discussion within 30 days of written notice. If unresolved, the matter may be referred to arbitration under the Arbitration and Conciliation Act, 1996, to be conducted by a sole arbitrator appointed by the Company. The arbitration proceedings shall be held in Bengaluru. 
  1. Severability: 
    If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. 
  1. Entire Agreement: 
    These Terms constitute the entire agreement between you and WealthNest.AI and supersede any prior communications or understandings regarding your use of the platform.

  1. Eligibility & User Age Requirement
  • To register for and use the WealthNest.AI App or Website, you must: 
  • be at least 18 years of age and legally competent under the Indian Contract Act, 1872; 
  • be a resident or non-resident Indian permitted to use such services under applicable Indian laws and foreign-exchange regulations; and 
  • use the platform only for personal, non-commercial purposes. 
  • By creating an account, you represent and warrant that you meet these criteria. 
    The Company reserves the right to suspend or terminate access if eligibility is not met or verified. 

 

  1. Refunds & Failed Transactions
  • Digital Transactions: All payments made through WealthNest.AI or its partner gateways are processed in real time via secure, regulated channels. 
  • Refund Policy: Once a transaction is successfully completed, it shall be deemed final and non-refundable except where mandated by law or regulatory direction. 
  • Failed Transactions: In case of a technical or network failure resulting in debiting of funds without corresponding service delivery, the amount will be automatically reversed to the user’s source account within 7 to 10 working days, subject to confirmation from the payment intermediary or partner bank. 
  • Chargebacks: If a chargeback is initiated, WealthNest.AI and its payment partners reserve the right to investigate and, if required, suspend the concerned user account pending resolution. 

 

  1. Force Majeure

WealthNest.AI shall not be liable for any delay, interruption, or failure in performance arising from events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, civil unrest, strikes, network or telecommunications failures, power outages, or governmental restrictions. 
During such events, obligations shall be suspended for the duration of the force-majeure condition without penalty. 

  1. Notices & Communication
  1. User Communication: All official notices or communications from WealthNest.AI will be sent via e-mail, in-app notification, or website posting. 
  1. User Notices: You may contact the Company for legal or contractual notices at support@wealthnest.ai or by registered post to the address stated in these Terms. 
  1. Deemed Receipt: Notices sent electronically shall be deemed received within 24 hours of transmission; notices sent by post shall be deemed received within 7 business days of dispatch. 
  1. Assignment & Transfer of Rights

You shall not assign, sublicense, or transfer any of your rights or obligations under these Terms without prior written consent of Tatvartha WealthNest AI Private Limited. 
The Company may assign or transfer its rights and obligations to any affiliate, successor, or acquirer in connection with a merger, restructuring, or sale of assets, provided that such entity assumes equivalent obligations under these Terms. 

  1. Accessibility & Inclusivity Statement (Optional)

Tatvartha WealthNest AI Private Limited is committed to ensuring that its digital platforms are accessible to all users, including persons with disabilities. 
Reasonable efforts are made to design and maintain features compatible with assistive technologies and to provide alternate means of access or assistance upon request at help@wealthnest.ai.
